About us
Witty Geeks is the trading name of Wittygeeks Ltd, a company registered in England and Wales under company number 17207197. Our registered office is at The Account Box, The Media Centre, 7 Northumberland Street, Huddersfield, HD1 1RL, United Kingdom.
When we say "we", "us" or "our", we mean Witty Geeks. When we say "you" or "your", we mean the person or business using our services.
Who our services are for
Our services are for businesses, sole traders, organisations and individuals acting for business purposes. You must be at least 18 and able to enter into a contract. If you sign up on behalf of a business, you confirm you have authority to agree to these terms for that business.
What we do
We offer simple digital solutions, including:
- Social media management: planning, creating, scheduling and publishing posts on your behalf, plus replying to comments and messages where agreed.
- Posting to your accounts: publishing content to TikTok, Meta platforms (Facebook and Instagram) and any other platforms you choose to connect and authorise.
- Digital services: such as digital marketing, brand development, business photography, content creation and related support.
The exact work, timings and price for your project will be set out in a proposal, quote or order ("your order"). If your order and these terms disagree, your order wins.
Your responsibilities
To help us do great work, you agree to:
- Give us accurate information, and the logins, permissions and materials we need, on time.
- Make sure you own, or have permission to use, anything you send us (logos, photos, music, text and so on).
- Review and approve content when we ask you to. If you don't respond within the agreed time, we may treat the content as approved where your order says so.
- Keep your own account passwords secure and tell us straight away if you think an account has been compromised.
- Make sure your products, services and claims follow the law and advertising rules (for example, the CAP Code).
Delays in getting what we need from you may delay our work. We're not responsible for delays you cause.
Your social accounts and your right to disconnect
You stay the owner of your social media accounts at all times. When you connect an account, you allow us to access and post to it only for the services in your order.
You can disconnect us at any time. You can remove our access through the platform's own settings (for example, the connected apps or business partner settings in TikTok or Meta Business Suite), or by asking us to do it. Once access is removed:
- we will stop posting and stop accessing that account;
- any scheduled posts for that account may not go out; and
- you still need to pay for work already done, as set out in the "Ending our agreement" section.
When our work ends, we will remove our own access to your accounts and delete stored login details within 30 days.
Payment and invoicing
- Prices are shown in your order. Unless stated otherwise, prices are in pounds sterling.
- Invoices are due within 14 days unless your order says otherwise.
- If payment is late, we may pause the services until it is paid. We may also charge statutory interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
- Paid advertising spend (for example, boosted posts or ad campaigns) is separate from our fees and is paid by you, either directly to the platform or as set out in your order.
Acceptable use
We won't create or publish content, and you must not ask us to, that:
- is illegal, misleading, defamatory, hateful, discriminatory or harassing;
- infringes someone else's copyright, trade mark or other rights;
- breaks the rules of the platform it's posted on;
- contains spam, malware, or fake reviews and engagement; or
- promotes products or services that are banned or restricted without the right permissions.
We may refuse or remove content that we reasonably believe breaks these rules, and we'll tell you why.
Intellectual property
- Your stuff stays yours. You keep ownership of everything you give us. You give us permission to use it to provide the services.
- Work we make for you. Once you have paid in full, you own the final content we create specifically for you (such as posts, graphics and photos), unless your order says otherwise.
- Our tools and know-how. We keep ownership of our templates, methods, software and anything we made before or outside your project.
- Third-party materials. Stock images, fonts and music are licensed under their own terms, which you must follow.
- Showing off. We may show work we've done for you in our portfolio and on our social media, unless you ask us not to.
Data and privacy
We take your data seriously. We handle personal data in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018.
- We only use data from your connected accounts (such as posts, insights, comments and messages) to provide the services you asked for.
- We don't sell your data, and we don't use it to train AI models or for our own advertising.
- When we handle your customers' personal data for you, we act as your data processor, and you remain the controller.
- We keep data only for as long as we need it, then delete it.
For full details of what we collect and how you can control it, please read our Privacy Policy.
TikTok, Meta and other platforms
When we post to TikTok, Facebook, Instagram or any other platform, both of us must also follow that platform's own rules, including:
- TikTok Terms of Service and Community Guidelines;
- Meta Terms of Service, Instagram Terms of Use and Meta's Community Standards; and
- the terms of any other platform you connect.
These platforms are run by other companies. We don't control them, and we can't promise any particular reach, followers, engagement or sales. If a platform changes its features, limits our access, or suspends an account, we'll let you know and do our best to work around it, but we aren't responsible for their decisions.
Limits of our liability
We'll provide our services with reasonable care and skill. However:
- Our total liability to you for anything connected with our services is limited to the fees you paid us in the 2 months before the claim.
- We're not liable for lost profits, lost business, lost data, or any indirect or consequential loss.
- We're not liable for anything caused by a third-party platform, your own content or instructions, or events outside our reasonable control.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to limit.
Ending our agreement
- Monthly services: either of us can end them by giving 30 days' written notice (email is fine).
- One-off projects: if you cancel after we've started, you pay for the work done so far, and any deposit is non-refundable unless your order says otherwise.
- Straight away: either of us can end the agreement immediately if the other seriously breaks these terms and doesn't fix it within 14 days of being asked, or becomes insolvent.
When things end, you pay any outstanding invoices, we hand over final content you've paid for, and we remove our access to your accounts as described in the "Your social accounts" section.
Governing law
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales. We'd always rather sort things out with a friendly chat first, so please get in touch.
Changes to these terms
We may update these terms from time to time, for example when the law or platform rules change. We'll post the new version on this page with a new "last updated" date. If a change materially affects an ongoing service, we'll tell you by email at least 30 days before it takes effect.
